Trademark Registration in Mexico

A trademark in Mexico is protected only once it is registered with the IMPI (Instituto Mexicano de la Propiedad Industrial). Mexico follows a first-to-file system, so registering early is the best protection for a brand entering the market.

Why trademark registration matters

It gives you the exclusive right to use the mark for the registered goods or services.
It lets you stop copies and counterfeit goods, including through customs.
Marketplaces and distributors often ask for a registration before listing your products.

The registration process

Search: check the IMPI’s database (MARCia) for identical or similar marks.
Classify: choose the classes of goods and services under the Nice Classification (45 classes).
File: apply online with the IMPI and pay the official fee.
Publication: the application is published in the Industrial Property Gazette.
Opposition: third parties have one month from publication to oppose.
Examination: the IMPI checks the formal and substantive requirements and may issue objections you must answer.
Grant: the IMPI issues the registration certificate.

Maintenance and renewal

A registration lasts 10 years from the date of grant.
You must file a declaration of use within three months after the third anniversary of the grant, or the registration lapses.
Renewal can be requested within six months before or after expiry, together with a new declaration of use.

Enforcement

The IMPI can order administrative measures against infringers, such as seizures, and registered owners can record their marks with customs. Keep evidence of use, such as invoices and advertising.

Before you file

Decide whether the mark will be owned by the Mexican company or by the parent company abroad, and file in the classes that cover your future plans as well as current products.
